Visas and Residence Permits – the Legal Framework Ensuring the Mobility of Foreign Nationals in the Republic of Moldova
The Importance of the Visa and Residence Permit Regime for Individuals and Companies
In the context of globalization and increased mobility, the legal regime governing visas and residence permits has become an essential element for planning economic, investment, and personal activities in the Republic of Moldova. Both individuals and companies intending to employ foreign nationals must comply with a complex regulatory framework based on clear eligibility criteria and rigorous administrative procedures.
A visa or residence permit is not a mere formality, but confirmation that the foreign national meets the legal requirements regarding the purpose of entry, means of subsistence, personal and professional integrity, and compliance with the state’s security interests.
Holding a valid legal status entails significant advantages:
- secure and predictable access to the Moldovan labor market;
- the possibility to carry out investment and entrepreneurial activities;
- legal stability for employers and foreign employees;
- avoidance of the risk of sanctions, cancellations, and entry bans.
The absence of a valid permit or non-compliance with its conditions may result in:
- substantial fines for employers and individuals;
- cancellation of the right of residence;
- expulsion and a ban on entry into the Republic of Moldova for a determined period.
Main Types of Visas and Residence Permits
The legal regime applicable to foreign nationals is regulated by Law No. 200/2010 on the Regime of Foreigners, as well as by secondary normative acts issued by the Government and the General Inspectorate for Migration.

This visa allows the foreign national to remain in the airport transit area of the Republic of Moldova for up to 5 days.
• Transit Visa (Type B)

2. Residence Permits in the Republic of Moldova
A residence permit grants a foreign national the right to reside and, where applicable, to work in the Republic of Moldova. The main types are:
• Temporary Residence Permit
Granted on the basis of a long-stay visa and issued for purposes such as:
- employment-based immigration;

The validity of the permit ranges from 1 to 8 years, depending on the legal ground.
• Permanent Residence Permit
Granted after a period of continuous and lawful residence, subject to compliance with the conditions set out in Law No. 200/2010. It provides:
- extended access to the labor market;
- additional social rights;
- long-term legal stability.
Stages of the Procedure for Obtaining a Visa and Residence Permit
Immigration procedures require a careful approach and detailed knowledge of the applicable legislation:
- Determination of the legal ground – analysis of the activity or purpose of stay and identification of the appropriate type of visa or residence permit.
- Preparation of the file – identity documents, financial evidence, employment contracts, diplomas, company documents, medical insurance, criminal record certificates, proof of ownership or use of residential premises.
- Submission of the application – to the diplomatic mission of the Republic of Moldova (for visas) or to the General Inspectorate for Migration (for residence permits).
- Compliance assessment – verification of documents, interviews, and requests for additional information.
- Issuance of the visa/residence permit and registration in official registers.
- Monitoring compliance with residence conditions – the foreign national must declare relevant changes and comply with the duration and declared purpose of stay.
In practice, difficulties frequently arise due to incorrect interpretation of the legal ground, incomplete documentation, or inconsistencies related to the employment of foreign nationals. For this reason, professional legal assistance is essential to avoid refusals, cancellations, or revocations.
